ITALY FINES VOLKSWAGEN FOR CHEATING EMISSIONS CONTROL SYSTEMS


The Italian Competition Authority (AGCM) found, on the 4th of August 2016, that Volkswagen AG and its subsidiary Volkswagen Italia SPA (VW), have been jointly breaching the unfair commercial practices provisions.

According to the AGCM, the fact that VW did not disclose that their vehicles were equipped with a device that would cheat emissions test is an unfair commercial practice.

Such practice was considered unfair by the AGCM since it materially distorted the economic behavior of consumers: The AGCM ruled that such practices led consumers to take a decision that they would not have taken had they been aware of the actual features of the vehicles at stake.

Weclaim has always been advocating that consumers would have never bought (or for a lesser price) the car had they knew about the defeat device.

The AGCM also objected that VW made claims about “green environmental advantages” in informative catalogues, which turned out to be wrong.

The AGCM fined VW for 5 million euros, which is the highest amount the Authority is allowed to impose. This constitutes a victory for consumers and a warning to other businesses that are misleading on their commitments regarding the environment and corporate social responsibility.
