EU 261 Regulation is applicable in the following situations:

Leaving the EU

Your cancelled flight is covered everytime your departure point is a European airport, no matter who the operating air carrier is. For instance, a flight from Milan (Italy) to New York (USA) operated by Delta Airlines is covered.

Arriving in the EU

Your cancelled flight is covered if your arrival point is a European airport, as long as the operating air carrier is European, no matter where you come from. For instance, a flight from Rio to Paris with Air France is covered.

Important note: Island, Norway, Morocco and Switzerland and the so-called "outermost regions" (i.e. French Guiana and Martinique, Mayotte, Guadeloupe and La Réunion, Saint-Martin, Madeira and the Azores, and the Canary Islands) apply the EU 261 Regulation as well.

You are entitled to compensation even if you have been rerouted or refunded. You will not be entitled to compensation if the airlines notified you about the cancellation 14 days or more before the scheduled flight and/or if your flight was cancelled by extraordinary circumstances.

Important note: If you arrive to your final destination on an alternative flight (a) by less than two hours, in respect of all flights of 1500 kilometres or less; or (b) by less than three hours, in respect of all iEU internal flights of more than 1500 kilometres and for all other flights between 1500 and 3500 kilometres; or (c) by less than four hours, in respect of all flights not falling under (a) or (b), the operating air carrier may reduce the compensation by 50%.

Whatever the reason behind the cancellation of your flight, you are always entitled to choose between a ticket refund and a rerouting.

Ticket Refund

The law provides that airlines must refund your ticket no later than 7 days after the scheduled flight by bank transfer. You are entitled to a refund of both your outward and return flights if the return flight is cancelled and to a refund of your return flight if you have already flown your outward flight.

Rerouting

You are entitled to a rerouting flight to your final destination under comparable transport conditions, either at the earliest alternative or at a later date of your choosing, subject to seat availability.

While waiting for your rerouting, you are entitled to:

  • Customer care: Eat, drink and phone while waiting for the rerouting flight at the expense of the airline.
  • Accomodation and Transportation: Get the airline to pay for accommodation (if rerouted the next day) and transportation from and to your place of stay.

Important note: If your travel has started and your connecting flight is cancelled: you are entitled to a return flight to the first point of departure, at the earliest opportunity (example: you were supposed to go to Italy from Lyon and your connecting flight is cancelled: you can obtain to go back to Lyon if you no longer want to go to Italy)

You are not elibigle to compensation in the event of "extraordinary circumstances", which are considered to be out of the company's control and were unavoidable even if all reasonable measures had been taken.
