Montreal Convention: Is compensation for lost, damaged or destroyed luggage per person or per bag?


What to do if your belongings have been packed in your travel companion’s bag, which was either lost, damaged or destroyed.

Luckily, one’s entitlement to compensation for lost, damaged or destroyed luggage is per person and not per bag.

This means for example if you packed some or all of your belongings in for example, your partner’s bag and your partner’s bag was lost - your partner would be eligible to make a claim for the cost of the items (plus reasonable reimbursement for necessities) up to the value of whichever regime applies, and you would also be able to make a claim for the lost items (plus reasonable reimbursement for necessities) relating to the same bag.

This applies to US domestic flights, as well as international flights covered under the Montreal Convention.
