A flight from Toulouse to Malaga operated by JetairFly was scheduled to leave on Saturday 3 September at 6 am. Due to major delays, the flight finally arrived at its final destination on Sunday 4 late at night.
126 passengers were delayed.
The delay was caused by a technical issue on the plane. The airline had to change the defective piece on the plane. which caused the flight to be delayed.
A technical issue is not considered as an extraordinary circumstance under EU regulation: therefore, JetairFly has to offer compensation to all passagers of the delayed flight.
Articles 6 and 7 of the European Regulation 261/04 provide that passagers delayed by more than 3h are entitle to receive 250 euros for a flight of 1500 km or less.
